Will the Regulatory Fog Clear? — The CLARITY Act and Bitcoin’s Inflection Point
The Digital Asset Market Clarity Act of 2025 could become a defining regulatory shift for crypto. It aims to split oversight between the SEC (U.S. Securities and Exchange Commission) and the CFTC (Commodity Futures Trading Commission), clarifying that Bitcoin and Ethereum are “digital commodities” under CFTC jurisdiction. This removes long-standing uncertainty around the Howey test and reduces regulatory risk. Yet, despite passing the House, the bill remains stalled in the Senate. Key conflicts include stablecoin yield restrictions and DeFi developer liability, reflecting a structural clash between traditional finance and the crypto asset industry. Jurisdictional boundaries between the SEC and CFTC also remain under negotiation. Market impact hinges on this clarity. Institutional participation could accelerate, especially with improved custody rules that remove balance sheet constraints. Exchanges and brokers would face stricter compliance, increasing costs short-term but boosting trust long-term. Crucially, market psychology remains constrained. Coinbase Premium Index data shows persistent negative readings since 2025, indicating weak U.S. spot demand. Even during price rebounds, the lack of sustained premium suggests futures-driven rallies rather than genuine spot accumulation. This explains the current range-bound and unstable price action: liquidity is returning, but confidence is not. The CLARITY Act could fill this gap. More than regulation, it represents a structural shift in how Bitcoin is priced—moving from liquidity-driven to institutionally anchored demand.
